How are you going to be able to run NTEK when you are sentenced to 3 years in prison for the federal crimes that you have already admitted to?

(NOTE: I'm reposting this to one of David's posts so I know he'll at least see it).

You say you're Nuvola NP-H1 is approved by the FCC, UL and has a CE mark.

Well, I went to the UL website:

I then clicked on "Contact," then clicked on "USA" at the bottom of the next page, then picked the San Jose, CA branch to call. The person at that branch then explained how to conduct a search myself. She said in the grey area under "Tools," click on "Online Certifications Directory." Click on it, then type in the company name.

I was told that it doesn't matter which office you call in any State. They all have the exact same data base, and it covers the entire globe.

While I was on the phone, she offered to do the search for me. She typed in Nanotech Entertainment. Also typed in Nano Tech Entertainment (just in case). Nothing. I then told her to type in just Nanotech. There was nothing for nanotech 'anything'. Then she typed in just Nano. There were some companies with Nano in their name, but none were NTEK.

She told me to contact you and get the UL file number. So, would you please provide the file number for your U.L. certificate. That should be a piece of cake and would put to rest any questions.

Next, you say you have a CE mark. I can find any evidence of any CE mark issued to your company. It would help if you would provide the name of the private company you used to obtain your CE mark, and any file numbers (or whatever) that were issued to your company.

As far as the FCC in concerned, I called but they were already closed. I will check with them tomorrow. I have the cell phone # of one of the supervisors with the FCC. I'll let you know what he says.

Would you buy a NP-1 to watch NanoFlix exclusive content? Sammy Davis Jr, Wine Channel, The History of Video games. Those will be streaming in native 4k so it would look better than upconverted content.

Wow they are the same... interesting.... And guess what, 100's of other devices like Xbox, Blu ray players, 4k TVs, Apple TV, Roku, etc all use the H.264/MPEG-4 codec. So if you have any of those, there is no reason to buy a NP-1. Unless that is you want to watch NanoFlix exclusive native 4k streams like Sammy Davis Jr, and the Wine Channel. Because Native 4k is obviously better than upscaling/upconverting...

I have been saying all along he will get his time. No probation. I am a bit surprised that he got a departure from the 33-41 months. However, 24 months seems to be the Federal Sentencing for small time white collar crimes these days. This is the third 24 months sentence in a row for my fraudsters. I have another that is being sentenced on Feb 24 in the Southern District of Texas who is looking at 50 years. But I am guessing 3-5 years for her.

As I mentioned earlier, it was strange that Foley did not post his outcome. Therefore it told me he either was continued, or sentenced. And as I mentioned weeks before and earlier today, if he was sentenced, he will be provided 6-8 weeks to turn him into a facility as specified by the Federal BOP.

As far as appeal, all federal sentences are already reviewed by the US Circuit of Appeals.

Since he chose to take the plea, he knew what the sentencing range was based on his criminal history and elevated levels as described by the indictment. To file an appeal that the plea is unacceptable and the counsel is IAC is complete BS. Now he is making a mockery of the court, the judge, the AUSA, and the US Attorneys office.

What he is doing is going to cause him to get the 33-41 range and not the 24.

His arrogance and ego will cost him another year. In addition, the BOP will disallow him a 12 month go at house arrest or half-way and 9 months of minimum security.

Instead, he will get screwed and get 44 months, all inside the BOP.

By the way, does he really think a Georgetown University Law grad is IAC? It is not like he got representation by a counselor who passed the bar out of a cracker jack box. Hello, IVY League anyone?

Ninth rejects his appeal, rejects the departure at 24 months, and he gets 41 months. No 12 month early release on house arrest or half-way. But the court will consider his facility request. The BOP is under no obligation to accept the recommendation of the court on his residency. They can send him to Alabama if they want.

Not a smart move, risk v. reward is not in his favor.

This also tells me he is a recidivist, and his ego has caused NTEK to be put in harms way. There are skeletons in the closet, and NTEK and its shareholders will pay for his choices.
