Why would you insist that you would pay a FRAND rate if you wasn't infringing? Thats about as dumb of a comment as I think I ever heard of, its all but saying hell yes we use your technology.
In fact I would think the ITC and the ALJ would have to consider this and say what the hell are they doing and saying. Should make their decision easier.
