fmilt, I would venture to say that you feel exactly like many longs here today. Glad its over but the verdict is not what I had conservatively estimated. I maintain there is more to it that will be hidden in a 3G contract.

fmilt....Don't think for one minute that we settled for the cash value of past infringement. Rather, we settled for the long term relationship with Ericy and the credibility that that relationship gives us in the industry.

Many, including myself, believe that the certainty of these issues greatly outweighs the risks and speculation of trial - even if we could have obtained substantially more.

Remember, a jury verdict is never a given and there would no doubt have been an appeal spanning over the course of another 2-3 years. During this 2-3 year period, we would not have the benefit of the credibility factor and as a result we may have lost the window of opportunity for the 3g rollout.

fmilt - We have no idea how the Court ruled on the Markman report, and further, we don't know how "narrow" the issues became after the Court ruled on the motions for partial summary judgment. Accordingly, if you are talking about "fairness" in the abstract, it is hard to argue with your position (based on these early indications). On the other hand, if you are talking about evaluating the deal vis-a-vis what they stood to gain through the legal process, we just don't know where that road was leading us.

With respect to 3G, I don't think that the parties are anywhere close to an agreement, based upon Howard's comments (and that surprises me).

imvho: in speaking with a fellow employee today, their thought was the settlement with Ericy will in turn
gain past royalties from Nokia and Samsung which should
be in the ball park of 300 million, due to IDCC getting the deal with Ericy..Not bad money...
