Would seem a bit unusual if they got off Scott free, by hiding behind an agreement.

MAYBE..its Tantivy that wants to proceed to trial rather than Lucent!!...Perhaps we believe that Lucent wilfully infringed and is liable for damages plus all Ct costs.If we have a Lucent employee that will testify that he/she was ordered to destroy docs..docs that can PROVE Lucent was wilfully infringing.. WHY settle UNLESS Lucent can make it lucrative to do so?!!
