To the contrary, I believe that if LU proceeds to trial in the face of this recent order and memorandum, they must believe that they have an extremely strong case. I would not consider a trial as being bullish for Tantivy. I suspect that after the judge has a meeting with the players, he will know who paid attention and who did not. In fact he will ask how far apart the parties are and why.
