My anticipation includes the following:

1. IDCC will receive its arbitration confirmation sought in NY.

2. The Delaware judge and Nok now have big problems as a result of the KYO license. First and foremost, Nok should not have standing as a licensee to challenge any of its now licensed IDCC technology. Even if the Delaware judge fails to follow the law as Judge Lynn attempted and allows Nok standing and subject matter jurisdiction, the law is clear that Nok must challenge the entire portfolio of IDCC preventing Nok from picking and choosing a few patents in its attack. This is a massive undertaking and opens the door for possible cross-actions which Nok so richly deserves. Thus, the suit is obviously premature, more costly with each new issue by the USPTO, more and more subject to the exposure of the Nok scheme as a former 3g development partner and purported good faith licensee and weakening with each additional licensee that IDCC garners in the interim. At some point, the judge in Delaware will have to face the overall picture and tell Nok to go home and come back when they are no longer a licensee and face the risks of an intentional infringer when mounting their patent challenge and can portray their design around system products that purportedly do not intersect the patent claims of IDCC.

3. Additional licensees will be announced as a result of the most recent accomplishments.

Sail, do not pay attention to the doom and gloomers over the reaction to KYO. Those that complain are focused solely on one stock and have been given previews of matters to come far in advance of the announcement. The institutions that will drive this stock will get the information through the sell and buy side analysts in the normal course of business and the reaction will take place. Many here are so hyped up that they expect a trading halt with every notice of a company SEC filing or PR. IDCC is and has been executing its business plan which is multifaceted and includes the following:

1. Creating, patenting and defending its technological advances.
2. Increasing cash flow and quarterly revenue streams.
3. Acquiring technological breakthroughs of others for immediate applications and anticipated future applications.
4. Productization and practical useage of their technology in the sector that corrects current and former problem areas and saves costs by its implementation.
5. Seeking and securing front line positions on standards committees to promote their technology and have a better understanding of the technology of others and movements toward systems in the sector.
6. Constant work on compatability of the many systems being promoted by others. I am impressed with their diversification despite remaining fairly streamlined in its number of employees.
Given the right additional licensees over the next few months, some of our strongest American critics in the sector may finally recognize and support us. Once this occurs, we will all see increases in volume and price and the multiples will be far more generous during the run.
