They are here to have people sell or cause panic not only for this board but also the other ones in WAMU!!

The preferreds should be trading higher and they are also tanking!!

To me this makes no sense!!

Thank you for taking the time to write this and it is as spot on as it gets. God bless the informed here and other places who try to speak clarity to the situation day after day, even when the hyper-emotional and other-motivated posters keep whining.

Some, such as you Fish, have clearly grown through this process and it will make us better people and better risk assessors through-out life. Others have chosen the victim route as the case has progressed. This is a stock and not a life commitment. Only a few here were personally wronged by the actions of the parties involved. Almost all of us, including me, were poor risk assessors, as we watch this case through rose colored glasses. That is not the fault of the EC, parties to this case or the Judge. We can buy or sell at any time.

Regardless of mediation or how much of a better position we are in now, compared to a year ago, this case still has risk. If you don't understand or cannot assess where we are now, you don't need to be in this stock. All the "I demand justice" and the Judge is unfair posts will do nothing to change the outcome.

Do your homework. Understand the risk AND the process, then make your decision. At some point, this case will close and how I come out of it, is in my hands and my hands only.

Nice post and very emotional if I may add. However I can't believe you advocate for this judge when you know she has been taking decisions without a list of assets. Now I don't know shiat about bankruptcy law but my common sense says that that should be illegal yet she can get away with it in plain daylight...

When we survived last January the NOLs increased.
Who knew we would be able to increase the NOLs by surviving past January 1 yet again?
Only because our Judge, acting within the Rules of Bankruptcy, found a justification to keep us alive.

fsshon, your perspective sounds like the glass is half full.

I could easily take the opposite opinion and say the glass is half empty..

Some key points:

1.) Should have asked for an assets list which after 3 years, she still has not done.

2.) Should have realized Rosen turned against us when he said, "shareholders are trying to milk JPM." Yet she did nothing.

3.) Months later, in court, she had to again remind Rosen that he represents shareholders.. "your clients" is what I think she said..

4.) Why not put all the claims on the table... FDIC, JPM, WMI, Inc and let's see, who really has the most claims. This crap about the estate not being able to recover enough money against the claims of JPM/FDIC is crap and she knows it...

5.) Should have asked JPM to explain in detail their $54B in claims... She just assumed they are good and is using that against us, in both of her opinions.

6.) She also inserted herself as litigator in her opinions. That's not her job...

7.) Oh, and if this Judge is so great, then why is the EC appealing her rulings????

8.) etc, etc, I could go on and on...

Also, I keep hearing everybody say, "she could have easily wiped us out"... Really? I thought this Judge was your hero? How could she have easily wiped us out when there is money and claims for equity?

I could go on and on but why protect this Judge from citicism? Remember, the Government Civil Servants, like this Judge, work for us, the citizens. We don't work for her.

Thank you for that description. I do have one comment about this process. If a BK Judge finds during the testimony some illegality that cannot be ruled on in her courtroom by them, then does this illegality have to come up again in some other court proceeding and this Judge has to cover her eyes and ears to knowing what was stated under oath and recorded? So in other words can she hear but not do anything about criminal intent or action that comes out in her court because it is not for her to decide in this BK court? If so then does anyone else here think that this is what is wrong in America.

Hey that's not my job, nor anything I need to hear in this courtroom or take any action on, this is a BK court not criminal so I need to plug my eyes and ears and not record something that comes out that is criminal that has nothing to do with this BK case. I would assume her records from the court room would end up as evidence in some other criminal proceeding. I am not a legalese and do not plan on reading boring BK books as you suggest but I think hear no evil, see no evil, etc. etc. is what is wrong in America. I would think any Judge has latitude in their courtroom to do as they please with what they hear and record.

Not bashing you Fish just stating another opinion here and looking for how criminal activity evidence that comes out in a BK case where does that information end up, if anywhere?

Much needed post Don,

I have been around for the past two and a half years and certainly understand it is not easy to keep the faith when the deck is stacked against you in our case against equity.

If we look around how many Honorable people we find in the political arena - very few if any. Our judge found the stamina not to only save equity, but to attempt to reform a system which became arrogantly corrupt. This is where I agree with you that she should keep her title THJMW !

None of us is perfect, but it is doing the right thing in the end what makes America great.

Happy Turkey Day and have a good laugh (through tears) with George Carlin who perfectly described the American Dream...
