I believe the purpose of the motion was to retaliate for Diac's motion to exclude Markle as an expert witness even if the form of the motion was to exclude Diac's witnesses. Essentially a tit-for-tat. Markle got what he originally wanted. I see that as a win. Whether it would have been better to get Diac's witnesses and claims excluded is a different matter.

They actually went before the Judge regarding the motion that Markle filed (regarding Drago's witnesses) and the Judge ruled in favor of Markle.
