Scruffy, don't go all in on calls unless it is reversed and remanded. If it is affirmed in part, reversed in part, that is still probably an overall favorable result for IDCC....but we would need to see what specific claims construction got affirmed to know for sure how the stock will respond when the details are known.

If the ruling is "affirmed" and IDCC loses (< 5% chance IMHO), then I think we would get a haircut of 15 points or so before the stock starts to recover. Google is interested in IDCC because of the LTE/4G patents...but the 3G IP still has a lot of value.

If IDCC were to lose this round at the CAFC, then the focus (on the 3G patents) will move to the new case they just filed against Nokia, ZTE and Huawei. This case has a lot more patents, and those patents have addressed some of the "loose" claim terminology ("succesively sent transmissions" corrects the erroneously worded "continuous transmission")....so IDCC is almost sure to win the next round. But the main thing to focus on is the offer that comes from Google or Apple.
