Assuming that there are no other penalties, wouldn't they just consider that a cost of doing business and just start over again?

Absolutely. The only way to get some of this stuff to stop is jail time. Rarely do the financial penalties imposed by the regulators end up being enough to hurt the perpetrators of the financial crimes enough to make them stop. Their illegal activities are still far too profitable despite the fines and penalties. Much of the ill gotten gains get hidden in off-shore accounts and a lot of the penalties never end up even being collected. Even if some of the criminals are prohibited from conducting the same activities with publicly trading companies they often times just find new people or entities to use as fronts and continue to commit the same crimes hidden in the background.
