#110360 RE: spider69 #110325

"they are in negotiations" - there is logic to support this view ...

(1) If there were no negotiations whatsoever for the past few weeks, and HG/RT leaving did not restart negotiations, then either party, most likely IDCC, would have certainly requested the ICC award much earlier.

(2) Both the Nok due date and the Samsung start date were known for a long time. Accordingly, the Sam arb could have been rescheduled much sooner to allow for digestion of the Nok result but it was not, until just recently, notably after HG/RT were let go.

(3) The trigger mechanism and Ericy/SE settlements seem to have backfired on Nok. Nok needs to regain control their terms with IDCC.

(4) WM comments (about enforcing the award) and JP's comments (about no award yet) as you suggest may be positioning to offset the type of Nok leverage that concerns you re: our ASM.

(5) If there is a settlement, then there probably was a drop dead date of some sort, which would have been met, and the ICC award cancelled. In this case, we would expect to hear about it before the ASM.

(6) If there is no settlement and the ICC forwarded an award, then it will be released as soon as possible after receipt.

My intuition and logic suggest that a settlement is quite likely. Otherwise, an ICC award, while bittersweet, I believe will be favorable for IDCC.
