Well - their Lawyers come across as a bit petulant & sniveling, but they probably are making a valid point RE: Getting the documents that Mr. Thoma used to build his theory.
I would argue that any synthesis that Mr. Thoma did with that base data is 'Privileged Information' and he probably shouldn't have to turn over all that.
I'm betting that the Judge signs this order - if she hasn't already.
Also - I would argue that the Hedgies want to see exactly what Mr. Thoma has in hand - so they have a better idea where they slipped up (so they can avoid the same slip-up next time), and so they can figure out exactly how deep the DUNG they have stepped into may be.
