Very true - we had several patents under the "Patent Pending" for our software applications...Your correct in stating that that status grants the product holder certain rights. however - they were all submitted and searchable... so they certainly could have a product but so far nobody has turned up any patents..or patent pending status for them. In order to have a Patent Pending status one would first need to have submitted/filed the patent for review/consideration/protection status - once it is accepted/registered in the patent office they can legally use the Patent Pending status- and that is all public information.
