Not sure what "Working Patent" is referring to. You can have a patent without a Working product and you can have a Working product without a patent. If you're referring to them not having an approved patent yet, check out some newer product packaging, you might find it interesting when it states "Patent Pending". You don't have to have a patent to produce a product, it just protects you from product design infringement.
