My thought on the merger is that when it is announced, the company that they are merging with is not stated until such time as the merger is complete.
You think that would make the SEC happy? I don't. This company is being investigated for misleading public statements, some of them having to do with acquisitions that were announced but never really happened.
And once again: a merger is a corporate action, and must be processed by FINRA.
