I also like this. I would consider Bluzie's comment on making it perhaps a bit more concise, but that is more style rather than substance.

You articulated the emotional and factual aspects expertly.

You should submit this. Not so that people know how incensed the LTW holders are but to put a personal touch on things. I don't think this aspect of the LTWs has been made as apparent in comparison with, say, the WAMUQ.

Perhaps people think that the LTWs are a bunch of hedge funds! This at least demonstrates that it's individual investors who are being trampled upon.

In short, great job!

I think its "you" and how you feel (and how we all feel) and the sincerity comes thru as you express yourself.

I will say that whenever I had an important letter to write I would set it aside and re-read it once or twice and make those changes that I felt were appropriate ... be it to make more direct or to use better words ... but that is personal.

so my long winded .... thanks ... go to it when you feel the letter is "you."

Philipmax,

You have an excellent flare for writing with emotion, a good quality. May I make one suggestion regarding the substance of your letter, to guide the Court on how to rule in this matter.

Historically the LTW's have always moved with the institution that controlled the ownership. Anchor went to Dime and Dime went to Wamu. Each time the LTW's followed, with the new owner entitled to 15% and the LTW's entitled to 85%. The WAMU plan proposes to move the assets to JPM, the LTW's must also move with them. The error in negotiations of a settlement with JPM was made on behalf of Wamu's management. It is clear from their testimony when questioned by Mr. Steinberg, that they lacked knowledge of the matter. To correct Wamu management's error, the Court should send the LTW's to JPM.

PhillipMax, if you have not yet sent your letter to Judge Walrath, I would hope that you would also make reference to my analogy of JPig having no greater right to our Anchor Litigation proceeds than it would to any property contained inside each former WAMU safe deposit box.

This would make a much closer reference/analogy to what JPig is doing to DIMEQ, although the car example is a wonderfully vivid (and personal analogy - and I wish that I had thought of it).

In fact, I only came up with the thousands of former WAMU Safe Deposit Boxes (containing PERSONAL PROPERTY "OWNED" by individuals) analogy after reading your letter.

I hope that you can reference it; otherwise, please let email me with information on sending a letter to the court and I will hammer out a quick letter and cc the appropriate parties.
