First, let me say that it is nice to have a civilized conversation. But I think we are talking past each other a bit. What I was referring to was Diac's change of tactic in the state court case dropping his request for turnover. That has nothing to do with the fed case stipulations.

I do agree that there is huge risk for T-Mobile to wait for the final outcome of the state court case. They can guarantee that the patent will stay with Calypso by cutting a deal with us that provides sufficient funds to pay the money owed to Diac making his claims moot. As I have said before, even if we lose the patent next year we still were the owners of the patent when T-Mobile originally (and continually) used our technology so our claims against them will still be valid. The only way to settle those claims will be to settle the case with us. My point is simply that much more of what will happen over the next few weeks will be dependent on what T-Mobile decides is in their best interest rather than what Calypso may want.

you make some very valid points, i can only add that once again daic has demonstrated his propensity to switch course mid stream and tmobile has shown that they are more than willing to merely bite hence tmobile's best bet is to deal w\ a stable minded BOD while they can rather to get tangled midstream w\ daic again
