I think there's a lot of stuff that Teva claims that doesn't add up but to me the biggest question is why should Marth BS now and look like a complete idiot a couple of years down the road when tEnox's application is gathering dust at the FDA? …knowing Marth's motive would be reassuring.

Marth’s motive is keeping his job. He is following Yanai’s orders.

Turtle- Somewhere deep in Yanai's warrior mind, Sandoz is just a bunch of Swiss weenies who can't even pick a side. :-)

I now agree with you and Peter and the rationalization here looks like some I have seen on certain biotech boards (not as bad as CTIC et al but getting there).

I don't know what will happen with the t-Lovenox filing. But there have been other cases where generic companies have made claims expecting approval. Akorn and generic Vancocin comes to mind. There were even market rumors that crushed vphm stock about supply being cleared for import, orders taken and ready to ship. A few years have gone by and they're still waiting.

To what extent does TEVA always operate by keeping the competition in the dark? This can be done as well by dis-information as by being quiet.

I seriously doubt TEVA is attempting to damage MNTA in any way. They just want it to be harder for others to know when they can win.
