I couldn't agree more that MPartners wrote an excellent report...but they also were extremely conservative on future LTE/4G rates, which I believe will be at least 1.5% for IDCC. OTOH, they miscalculated IDCC's current 3G rates as .9% (which I believe are about .5%). It would be worthwhile for everyone to go back and review Tom Carpenter's August 2009 report and see what he said about 3G rates.

IDCC lost all their leverage with Nokia when ALJ Luckern made his erroneous claims construction ruling. IDCC has been severely beaten down by the market after the ITC ruling of noninfringement. But after the close of the CAFC briefing cycle, the world is starting to realize that IDCC has an extremely strong case at the CAFC. After carefully studying the briefs, I think the CAFC will overturn the ITC claims construction and return a directed verdict of infringement. I think Nokia knows what is coming. For anyone interested, I have posted my reasoning on this on a couple of discussion boards, including this one.

Nokia may very well try to settle before they are ripped in the oral arguments (when they will lose a lot of their negotiating power). Alternatively, Nokia may try to buy IDCC as posters here have surmised...but I doubt Apple (and others) would let that happen. For those of you who don't follow this market, Apple and Nokia have numerous lawsuits against each other regarding IP, and owning IDCC's patent portfolio would be like having the crown jewels. Once again, I think MPartners did a great job, but they were extremely conservative.
