Chunky, ... I'm a trial attorney and, for the last 20 years, I try cases in a relatively restricted area of the law.

I am not a securities lawyer. To answer your questions, I would have to learn securities law as if I had a securities law case to try. I have neither the time nor ambition nor curiosity to do so.

All that having been said, it looks like Hakala was willing to give Glisson a pass if he stopped buying/selling the shares and had a phone conversation with Nelson, Glisson's attorney. Her affidavit says Nelson told him Glisson would stop. His affidavit says he never told her that.

It goes to whether Glisson had the requisite intent to violate the securities law. He says he didn't know it was wrong and, anyway, his acts are not those of a broker.

In its present posture, the case screams out: "Settle this one." Perhaps that's what the judge had in mind when he "sent his message." ... eom
