IDCC has stated that Nok is not making any patent challenges in the arbitration. The UK suit is not a relevant factor; and, in fact, the psj's are not relevant factors for setting rates in the arbitration. Nok is seeking the work up sheets used by the parties in arriving at the 34.5 mil and the graduated royalty rate schedule contained in the SNE license. They are also seeking any correspondence and notes that might make reference to Nok in the possession of IDCC and Ericy/SNE. Finally, they are seeking the actual sales of products by Ericy, SNE and Sony from the inception to the most current reporting. Nok is attempting to get an effective rate set that is comparable to the effective rate of E/SNE for handsets under the "all relevant factors" clause in the Nok license.

There are no other relevant factors to be considered in setting the rate save and except discounts and the effect of the concessionary years.
