#36396 RE: downsideup #36395

Downsideup.....that was excellent. The only thing to add is that T-mobile is the smallest of the At&t, Verizon, Sprint, what I term the telecom QUAD. When and I definately mean when the patent is validated not only will T-mob have to in-license with CLYW till 2021 but so will the 3 bigger guys. Remember T-mob has the smallest share and still does billions. I think $10-25 is being nice. The QUAD earned what >$200 billion worldwide and they have done it for 6 years using ASNAP without paying for it. 3G and certainly 4G weren't around when the 923 patent was completed. I think the upside is similar to Qualcomm....just maybe not $90 share but $30-50 seems fair?

downsideup,

Thanks much for taking the time to give us the Reader's Digest version.

Very interesting to say the least,.. and with extreme potential.

Since T-Mobile did not have to deal with CLYW until NEXT Fall,...for them to have agreed to try and settle everytning in the next 90 days sounds very positive.

It also sounds like Daic doesn't have a firm leg to stand on, based on my interpretation of what you wrote.

I followed a friend of mine, westeffer, here,... and he spoke highly of you,... I understand why,... it sounds like you might have stayed in a Holdiday Inn Express all last WEEK.

Thanks again and much appreciated!

Excellent write up. Many thanks!! I feel for the long term owners of this stock, I've had similar pain in other companies.

Anyway, I stumbled into this today and it looks like I may be at the exact right place at the exact right time.

Looking forward to the ride. Sounds like it should be exciting.

Thanks DSU, always enjoy reading your posts. .
Nice DD summary....in a nutshell.....it leads me to wonder anew if TMob reps are reading this board, but they probably have many other good sources of relevant info available to them in their bailiwick.
This board is a useful source of not just background info, but also current thinking, thanks to some sharp folks who are active these days, and also various forward looking statements by many people.....many more this week than ever before.

Nice summary. Two questions:

1. If Daic has been selfishly depressing the stock for years, what reason would he have now to be reasonable/settle/go away?

2. Richard Pattin was ceo or president for several years. What happened to him and what effect did his tenure have on the company?

Thanks.

That was excellent downsideup. I would also like to add that this is not just a US patent. CLYW owns patent rights to this thing in much of the world and also has a pocket full of other patents that are also being infringed on.

Furthermore, we don't just have the big 4 to pursue for patent litigation. There are many many companies that are in the business of providing the technical means for the hand off. Think of the companies that produce the hardware for making the t-mobile@home product work. And the transport for the data. The chip manufacturers that imbed the code into their products. The pockets are huge here.

I have been following this stock for almost 7 years and have been investing in and out for just as long. Would love to see the old heads come back to the board. Didn't Final4 promise all the longs a huge party back when we were supposed to have a shareholders meeting? Come on who remembers that?

Anyhow I think that Qualcomm is an excellent comparison to this company and with Dave and Terinni at the helm, I think we have the leadership to hire the right people. We already have compitent legal representation in the wings and many powerful firms that have already offered to represent us. Remeber the Acacia deal? They were willing to front us 5 mil just for the right to prosecute and collect some of spoils of war.

This thing is headed for much higher than $2 if we retain the patent.

The way I see it, the following things could happen:

- T-mobile licenses the patent
- T-mobile exclusively licenses the patent
- T-mobile offers to buy CLYW and does so
- T-mobile buys up all the shares of CLYW at market price and secures a controlling position
- CLYW offers its patent portfolio to the highest bidder
- CLYW creates a real company in the convergence business, hires some folks with real vision and creates a powerhouse of a company in the telecom industry

All of those are posible considering the evidence over the many years. If t-mobile is willing to settle, they know there butt is hanging out, that CLYW has a case and the patent has incredible value. I don't see a down side to this thing.

Thanks, I have a quick question. Has it been mentioned how much CLYW was originally going for in terms of money?
