Seems Susman/EC wanted to discuss the sealed document and the Examiner in court at the same time if I remember correctly. If that is the case, then I suspect they felt pretty sure the other parties would succumb and say there is no sense in going for the examiner. Hence, I believe a settlement is in the making. IMO
