I think Susman's strategy is to completely obliterate Weil and take the whole law firm's lunch with him!
If Susman can push Weil and Rosen farther down the hole they have dug for themselves and then later come out with a reasonable POR he has done two things for himself, 1. Gained market share by obliterating his competition in the lawyering business and 2. Fulfilling his obligation to WMI Equity.
I think that has been the strategy of Mike Willingham from the very start. He has accomplished that in the Mirant case and will do it for WaMu as well.
