I dont think the appeals court will rule.

EC strat..hold on to appeals filing until second motions is signed.
JMW will not reject second motion for Examiner filing.

But just to keep pressure on all other parties dont withdraw appeal until examiner motion signed.

EC lawyers:dont really dont want examier. THEY WANT DOCS and DISCOVERY and STOP THE POR/DS.
