rosen clearly stated that the motion was out of her hands (the exainer motion) She thought about reversing her decision and Rosen said she could no longer as it had been appealed. At that point the Ec said that if she was inclined to re-visit the examiner they would withdrwal their appeal.
I dont see her signing this appeal as a good thing. a third circuit court could go either way. If that were to happen can another motion be filed to consider an examiner then?
Does it favor EC if the appeals courts rules in our favor cause jpm/WMI cant appeal?
or does it bury us if the appeals court rules against us and THJMW can no longer appoint an examiner.
She could enforce via cort orders i guess.
Am i way off here?
