If I were a lawyer that wanted to milk my absent minded clients that had given up management of their own BK process by hiring a law firm that then later contracted some of the work out to me then I would make it a long and complex process in which my plan did not meet the exclusivity period simply because I would get paid as much as possible and in the end NOT be responsible for the outcome!

Very interesting. I always like to look for prior examples for reference. Look at SCO's history. They too lost exclusivity.
