I've talked to a couple guys at the SEC who said a stock merely being on the pinks should be ample warning to all investors about it being very high risk. They said any person who decides to invest in a pinkie should not be surprised if/when he loses all his money. They also thought novice investors should not be playing in small caps at all.
There's so much garbage going on in the market the SEC has to pick and choose cases. I don't think they concentrate more on sophiscated ones. To me, it looks like they mostly go after those they can build open-shut cases against.
