Yes, the SEC revelation there was surprising. I am actually amazed at how brazen they’ve been, that the fine was so little is maybe not a surprise and am concerned that they might find a way to “inadvertently” continue doing it given that the cost of doing it is so low. The only solution is companies suing them. They’d run the risk of being revealed as doing it intentionally but so frequently they find ways around that. But if their liability becomes unsustainable and their insurance company becomes concerned, it’s a different issue.
But yeah, it makes official reporting on the number of shorts unreliable.
