If DBMM gets away with no sanction, after having been delinquent in filings for almost three straight years??
Other companies won’t feel the NEED to file. They won’t file and when the SEC opens an OIP for not filing? The lawyer for that company will point to any decision that lets DBMM off the hook for not filing and use it to defend the company!
That’s why this case is so important.
There’s been no other company that has taken a delinquent filing issue this far. Foelak opened up a real can of worms here, that the Board has to deal with.
The FACT of the matter is - no matter how many filings DBMM has made SINCE then, they had almost three straight years of delinquent filings that they have NEVER BEEN SANCTIONED FOR.
The Board cannot let that stand as a precedent for other companies to use.
Yeah I don’t by that precedent argument either. They spew that daily because it’s the only argument they have left. DBMM is currently setting the new precedent, one that doesn’t enable toxic lenders.
