You're correct. This is a derivative suit, and that will be the case should we prevail in court. I believe if there is a settlement out of court, however, the derivative suit will be dismissed. Make sense?

You are correct. A shareholder derivative lawsuit covers all shareholders, not just a few privileged ones. Basically a shareholder or shareholders replace management that is unable or refuses to discharge their duties to protect the corporation and ALL its shareholders. Its been said that the underprivileged shareholders here are not covered under the suit-that is incorrect. If you have the ability to support efforts you need to do so, but you are not a POS if you cant.
