I don’t wanna play semantic games. He told his followers he was gonna take control, price went up. Then he said he was only gonna do it to kill the company, price came down. George is obviously a worthless scum asshole but still, that was a shit move he made today. Have a great weekend!

Here is a synopsis.
Claims for negligent misstatement Excerpts from Investopedia and various Law Office websites.

There is common law and there are Statutes that define false and misleading statements, and legal recourse for victims who lost money or were otherwise injured by someone who knowingly or negligently made false and/or misleading statements.

As for disclaimers; ask Mr Alex DeLarge how that worked out for him. He was recently arrested and charged under the direction of the U.S Attorney’s Office and also being sued by the SEC.

Similar but different to a claim for actionable misrepresentation are claims for negligent misstatements.
The usual claimant is the person who asked for the information or advice and to whom it was addressed. But in some situations it is possible for third parties to claim.

People read investment Tweets and ihub posts looking for information. Many posters put boilerplate denial of liability as their autograph. Sharp has a denial boilerplate, with a strange twist which negates the first sentence. It reads as follows; “Despite being a pain in the ass, you have to admit, I bring a lot to the table.” He also has many tweets that include statements referring to his proficiency.

In short my opinion is that people come to him via Tweeter looking for investment advice. He gives advice and they act on it. The nexus is obvious.
