There was a magistrate opinion to deny this request for dismissal, then the district judge asked for an actual hearing. This took place two weeks ago or a bit more, and we're expecting a decision by the judge on accepting or rejecting the request for dismissal in the next few weeks.
In any case, if it's accepted, we will appeal and we will continue to fight this.
And if it's denied, we also continue with that because we believe that we have a very strong position in terms of our real standing on this issue.

raf--gg (today) quoted karim (from yesterday's cc)--which was not reported till now. I am not sure when exactly J. Andrew dismissed the Magistrate's opinion, must have been a few weeks before the oral hearing.
