The judge requested oral arguments over the motion at hand after Hikma and Health Net objected to the R&R. I don't see anything that would make me think the judge wouldn't side with the magistrate. Given the significance of the case he may well have taken the view that allowing / inviting oral argument places his decision whatever it may be in a stronger light than if there had not been oral argument Alm
