Mischcon et al knew about the waterfall (sections 50-80 of the waterfall agreement) and/or when the transfer took place.

What was the malfeasance that the Attorney(s) knew about and didn't report it to the Court.

If I tell my Attorney I killed someone they aren't obligated to inform the Court - actually it is privileged communication - the client (Carter) would have to waive Attorney Client privilege.
