While I try to steer clear of conspiracy theories, it does seem that SCOTUS lasered in on the "or the Agency" language, ignored the fact that the FDIC also has this language, ignored that the subsection was labeled incidental powers, and performed some serious mental gymnastics to say that the Agency's best interests are those of the general public, thereby justifying the transfer of money to the US Treasury, whose interest is clearly being served moreso than FHFA.

I would have been happier if they just said "we don't want to fucking deal with it, just pursue the Takings claim." At least it would have been honest, instead of a blatant manufacturing of a ruling which gives every conservator in the future the right to take over and loot companies.

Yes, I agree...

And Sam Alito who is supposed to be a 'Bastion of Conservatism' and 'professed' that Judges 'should follow Constitution and not legislate from the Bench' has turned out to be the biggest Hypocrite around and is Exactly Doing that - "Re-interpreting Constitution according to his Whim & Fancy" & "Legislating from the Bench"...

SCOTUS -What a Bunch of Wimps -Bending Backwards to be 'buddies' with GubMent Wonks and for all their Talk, Not even a Shred of evidence when it comes to their Real Actions that they care about the constitution or defending the Law as laid down by the Constitution...

Excellent thread. This is exactly what has transpired. SCOTUS sidestepped their primary duties & responsibilities to uphold, defend and protect The US Constitution. They caved to the other 2 branches of Gov thereby reinforcing the belief that The Judicial Branch is the weakest of the 3. The precedent being set by this is terrifying.

Today the Supreme rules whichever way-the-wind-is-blowing

First they check social media websites to see what’s popular and what’s
not then they can make their ruling.

It’s like holding up your finger to see which way the wind is blowing before
they can do their jobs.

Great point. SCOTUS reads so much into "or the agency" citing very specific language and then apply a "by extension" that is not in the Act.
