Just think of the argument that Health Net are making on a simple common sense level. They said:

And why would Health Net know about patents directed to methods of treatment when it is legally prohibited from treating patients and prescribing and dispensing prescription drugs

Their attorneys are writing about patents that they claim not to know about. - does this pass any simple logic test?

Wouldn't a reasonable person say: so go read the effin patents!

Unless Healthnet was told(assumably by Amarin) that they were pushing patients to use gV for cvd issues. If Healthnet has been told about the issue, yet continued to push customers to gV, then they have a problem. Question I have - did Amarin inform Healthnet of the issue, and received confirmation that message was received, prior to initiating the lawsuit?
