Remember we have 600 million. We also should remember that we were caught unaware when JT suddenly raised this cash last year. Just maybe ( I do say maybe) JT became aware of possible nefarious carry on coming down the line, for some reason he suddenly decided to raise this cash and while we were shocked at this it does seem wise now. If Amrn sought an injunction at this point and lost two years from now think how costly that would be. This way Hikma must decide to either continue until the court decides which could be several years from now and if they lose face huge damages or they could pull back now. I think Amrn are playing this correctly (non legal mind).
AMRN is not going to seek an injunction now because they want to do some discovery (get documents and testimony) first. Once they can gather evidence from Hikma documents and testimony from depositions of their marketing people, they will then seek an injunction.
These infringement cases all hinge on the evidence. It’s more about the facts than the law.
