The Judges clearly said Du "weighed" the SCs yet then they said she went back and reviewed each one at a time and justified her decision - just like they did in Novo!
Novo is Case Precedent where the final determination said the SC's reviewed in any order would not change the decision of obviousness.
The Judges here said the same thing.
Singer said 4 or 5 times that the decision based on flawed evidence bled into the SCs creating unusual weight on them.
If the cropped Mori evidence was not altered, the SCs would have a much higher and positive effect on the decision.
You need to get the "Weighing" out of your mind!
You sound just like the Judges who didn't care. They kept asking Singer WTF he meant about something bleeding over to the SCs.
I completely get what he was trying to get them to do: Look at Mori!
Had he referenced the "But/If" in Novo, they would have had a pathway to look at Mori.
He didn't do that so they shut him down and based their decision on Novo...
