What just happened, and particularly by the speed it happened, reflects a decision based on opinion and/or bias
rather than objective consuderation.
AMRN was ambushed by three liberal judges who in part were protecting their own (Du).
This is ultimate travesty of justice.
If the above is not the case then AMRN was ill advised to pursue the original case and certainly not the appeal.
All was obviously obvious.
Beyond that it seems like the FDA, the USPTO, and the judicial system are dusjointed. And it appears that the ultimate authority on tecnical issues lies in the wrong hands.
Having several patents myself I would be hard pressed to suggest any company bear the cost of patent protection when the propensity is to allow others to infringe.
A very bad testimony for the US.
