Hi alm2. I am every bit as disappointed as you, on multiple levels. I consider courthouses to be cathedrals, and judges to be high level dispensers of justice, but when they reasonably and objectively fail to adhere to those lofty expectations, I hurt inside.
There are probably several things that can be done to wage war with the generics, but I am not so sure if any of that will help the stock price. As I explained previously, En banc and SCOTUS are not realistic possibilities. I believe that the second appeal will be dismissed based upon the Consent Order where the parties agreed that it would be bound by the results of the first appeal.
I do not see injunctive relief because the generics have FDA approved ANDAs, and won at both the District Court and Federal Circuit levels.
