The decision almost definitely is based upon the Briefs, but the oral argument is used to clarify some of the points in the Briefs, and answer the Panel's questions. While Singer's live presence would be optimum, the telephonic is the best that can be done amidst the pandemic. I would not worry about his ability on the phone, as I have not heard a single negative critique of Singer's lawyering ability anywhere from anyone.
