Now my recollection is refreshed. During our last discussion two months ago, we were all talking about whether shopping V for Generic Lovaza, would be actionable. The conclusion was that it was not actionable because GL would not be prescribed for someone with a R-It indication. But here, GV would be substituted even though it only has the high-tri label, and not the R-IT label. So for legal action to be ripe, there would have to be a GV launch.
