Hi,
I was a Pharmacist for 38 yrs, owned 2 stores and worked for several chains.. Question, If I fill my Vascepa Rx monthly/insurance for a yr and I always receive gen V, Is that not infringement???

In my professional opinion yes....the Ins company is allowing this infringement.... I know that when a patient signs up with an Ins co. he has to abide by their rules.. But, is the Ins co. allowing the generics to infringe????

Would it make sense for Amrn to change the name of V for any rx written for Marine usage vs any script written for reduce it usage? For example if Vascepa were called Trigcepa for use in triglycerides reduction, and retained the name Vascepa for cardio risk reduction, then the doctor, the pharmacist, the insurance cos, and Amrn would know that Gv could be substituted for Trigcepa but not for Vascepa. Since the generics do not or can not promote the drug for themselves then they could not be considered a substitute for the reduce it indication. Is this feasible?

You can't sue every doc, pharmacy or manage care plan. Not feasibly possible.

Not going to argue the substance of your post, as you have the expertise and I do not, but I take issue with the above quote.

Amarin would not need to sue "every doc, pharmacy or manage care plan". If possible, they would sue 1 or a handful and make an example, to defer other from doing it.

You're dealing with carve-out problems for two of your company's drugs? Care to name them? Nobody here could recall this situation occurring before with one exception, Wellbutrin vs. Zyban.

As far as "I hope this ends the long and hard fought battle many of you have been fighting against one another.", I almost laughed when I read that - you'd think people would learn, but you'd be wrong - this has been a topic for over 6 months and people keep repeating the same wrong things, and in some cases it's the same people even after they've been informed otherwise multiple times (won't name names, but a couple instantly come to mind) - ADHD or short term memory problems, who knows.
