You cannot blame Amarin if you do not know what the other side was willing to accept (if anything), and you do not know that.

If H & R said that they would only settle if they can enter the market on January 1, 2025, and that is not negotiable, would you want Amarin to take that deal? I hope you would not.

Same with the buyout. What if BP said that until the court validates the patent, they won't pay more than $10 billion ... or $20 billion after the win. Did you want Amarin selling for $10 billion, when their MC was almost that after the FDA approval?
