Amarin and FDA litigated 2 cases in Districts Courts, winning one in SDNY with a post-trial appeal settlement reached with FDA as later outlined and approved by the District Court Judge whose opinion is available in the FAQ section of Amarin’s website.
The opinion in the other D.D.C. NCE case is also available in above FAQ section. I have not read that opinion recently and do not recall whether some kind of settlement with FDA occurred in that case.
We may have influence with Amarin; but we have no control over its actions, absent a class action suit that would attempt to exercise/seize control. That would be futile, IMO.
