As I know Judge O'Malley, Newman and Reyna has "totality" approach (definitely deny "prima facie" approach), meanwhile the other Judges accept "prima facie" approach.
The 3 Judges (from the 12) could be selected by 210 different combinations … 4 is a "granted" overturn for procedural error … 1.9%.
Can you post more depth on this, I would think Chen would rate higher given his background at the USPTO and that he probably doesn't like judges overruling the Patent office based on layman's views of obviousness.
