The REDUCE-IT patents are now in the Orange Book. Any generic that wants to start marketing a generic version NOW will have to contend that their ANDA does not induce infringement on THOSE patents, and that the REDUCE-IT related patents are also NOT obvious.
Or do I have this wrong? The difference is a huge one.
Exactly! But it will take them 4 or 5 years to get to this point that the trial is at now...which IMO...will be too late to give merit to same arguments.
