HM, the opportunity for a "Fair and Reasonable" result is fun to speculate on. God knows we've had many years to do that. But, "the proof is in the pudding", so to speak. Nothing actually matters here but results.

hotmeat, you need to look at the documents I sent to your email then let the following paragraph sink in by looking at exactly what is used and said in the following paragraph from Amended POR 7 signed on 2/23/2012.

set forth in the Confirmation Order, the members of the Trust Advisory Board hereby designate William C. Kosturos in connection with the applicable provisions of the Delaware Statutory Trust Act, 12 Del. C. § 3801 et seq.

No attorney wants to think there is any money for equity that wants to close a bankruptcy. The problem here is all assets need to be distributed before a BK can be closed. A sort of catch 21 asap. So lets stop looking for. "proof' and get on with the BK closing. We might just find docs that prove our theory. I write this only because we continue to not receive any "judiciary responsibility" in this fiasco. If we are wrong then we may want to go for the jugular.

"...but I am not going to lie to myself just to feel good...."

Interesting comment. It's ALL about feeling good. The difference is short term needs vs long term needs.
Those who think short term need to feel good NOW, and they feel that way most of the time, very much the mindset of the drug- addicts or the religious.
Then there are the long term thinkers. Those practical thinkers can postpone short term feel-good for long term joy (even if it's less), which they perceive to be the better investment of their emotions and tone.

Both are just emotional survival strategies. But devils advocate requires the truth, which is that postponement of superficial happiness for the benefit of long term joy, requiring more emotional discipline, is more sustainable.
