I feel very sorry for your large unrealized (or realized?) loss, I really do. But none of the points you listed will likely ever make it to the courtroom. You could probably sue every other company on the OTC markets if missed guidance, some stock promotion with full disclosure and delays in product launches are legally relevant.
In the end, any litigation will aggravate the situation for all shareholders and it's highly questionable if a small healthcare company will have the funds to settle any damages.
On a positive note, please don't write off your investment just yet. The current share price is a fucking joke and lacks any correlation with fundamentals. The company is in an exponentially better shape than the share price reflects and we have a lot of exciting potential going forward. OTC generics, lucrative direct marketing in Canada, expanding into Europe the MENA region and in particular Asia (see iCare platform in corporate presentation) etc. At the same time expenses are seeing continuous improvement and those who claim otherwise simply haven't done the math. This stupid phrase "expenses are out of control and keep rising" you can read everywhere is simply untrue.
